These Terms & Conditions ("Terms") govern your access to and use of the website, services, and lead-generation programs provided by Smelt LLC ("Smelt," "we," "us," or "our"). By accessing our website, booking a call, or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our services.
01Our services
Smelt provides marketing, advertising, and lead-generation services for home-services businesses (such as HVAC, roofing, painting, and similar trades), including advertising campaigns, lead qualification, and appointment setting. The specific scope, deliverables, and timeline for your engagement are set out in your separate service agreement or order form, which forms part of these Terms.
02Eligibility
You must be at least 18 years old and authorized to enter into agreements on behalf of your business to use our services. By engaging us, you represent that the information you provide is accurate and that you have the authority to bind your business.
03Fees & payment
Our pricing consists of a refundable startup fee and a per-result fee, as described to you and confirmed in your service agreement. Unless otherwise stated, you pay $200 per booked job — charged only when a qualified lead becomes a paying job — in addition to any agreed startup fee. Advertising spend is billed by Smelt as part of your agreed monthly spend; we place and manage that spend on the appropriate platforms on your behalf, so you are not billed separately by Meta or other ad platforms.
0430-day guarantee
If our advertising does not place a single booked call on your calendar within 30 days of your campaign going live, we will refund your startup fee in full. The guarantee applies to the startup fee only and does not cover your agreed monthly advertising spend. Full guarantee conditions are set out in your service agreement.
05Client responsibilities
- Respond to qualified leads promptly and in good faith.
- Maintain the capacity, licensing, and insurance required to perform the jobs you book.
- Provide accurate business information, including service area, pricing, and availability.
- Comply with all applicable laws in your communications with leads and customers.
06Text messaging (SMS)
Who we are & what we send. Smelt LLC is a marketing and lead-generation company for home-services businesses. If you provide your mobile number and opt in, we send text messages related to your inquiry and our services — appointment reminders, booking confirmations, scheduling changes, and follow-ups about your strategy call — and, only with your separate opt-in, occasional marketing messages about offers and service updates.
Opt-out & support. You can cancel the SMS service at any time by replying STOP to any message you receive from us. After you send “STOP,” we will send a message to confirm that you have been unsubscribed, and you will no longer receive SMS messages from us. If you want to join again, simply opt in as you did the first time. If you are experiencing issues with the messaging program, reply with the keyword HELP for assistance, or get help directly at kyle.p@usesmelt.com.
Carrier liability. Carriers are not liable for delayed or undelivered messages.
Message frequency & rates. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Privacy. If you have any questions regarding privacy, please read our Privacy Policy.
07Intellectual property
All content on our website and in our materials — including text, graphics, logos, and software — is owned by or licensed to Smelt and is protected by intellectual-property laws. You may not copy, reproduce, or distribute our materials without our prior written permission.
08Disclaimers
Our services are provided "as is" and "as available." Results vary and depend on factors outside our control, including your market, pricing, responsiveness, and close rate. We do not guarantee any specific number of leads, jobs, or revenue except as expressly stated in the 30-day guarantee. Smelt is an independent business and is not affiliated with, endorsed by, or sponsored by Google or Meta.
09Limitation of liability
To the fullest extent permitted by law, Smelt and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or related to your use of our services. Our total liability for any claim will not exceed the amount you paid to Smelt in the three months preceding the claim.
10Indemnification
You agree to indemnify and hold harmless Smelt from any claims, damages, or expenses arising out of your business operations, your communications with leads and customers, or your breach of these Terms.
11Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Arizona.
12Changes to these terms
We may update these Terms from time to time. Changes are effective when posted on this page with an updated "Last updated" date. Your continued use of our services after changes are posted constitutes acceptance of the revised Terms.
